What We Offer
Declaration of Heirs
In the absence of a valid will, the Declaration of Heirs is the document that determines who or who has the right to inherit from a deceased person. The Declaration of Heirs can be requested through the ordinary procedure of the Court or be prepared through an act of notoriety authorized by a notary. The Declaration of Heirs serves as proof that the title of the assets belongs to the heirs. Without a will or declaration of heirs, a division of hereditary assets cannot be carried out or assets can be registered in favor of the succession.
Testaments
The will is the act by which a person disposes of his or her assets, or part of them, after his or her death. It determines, subject to certain legal limitations, the final destination of your assets. In the absence of a will, the distribution of the deceased's assets will be made following the general regulations imposed by the State. There are several types of wills, but the best known are the open will, the closed one, and the *holographic will. Regardless of what type of will it is, it must comply with certain formalities for its validity, which is why it is important to consult with a lawyer to draft it.
* In New York and Maryland, holographic wills are only recognized if they are made by a member of the Armed Forces. In Maryland, these wills remain valid only for one year after the testator leaves the Armed Forces unless they are no longer of sound mind under the law at that time.
Affidavit
A sworn statement, also known as an affidavit or testimony, is a notarial action that does not go to protocol and in which the notary expresses an event that occurred before him or that is known to him. The notary may authorize the following types of testimony: (i) legitimation of signature before a notary; (ii) that a document is a faithful and exact copy of another that does not appear in its protocol; (iii) that a document is a faithful and exact translation of another that does not appear in its protocol; and (iv) the identity of any object or thing.
